The U.S. Department of Commerce (Commerce) finds that there were no shipments of certain hardwood plywood products (hardwood plywood) from the People's Republic of China (China) during the period of review (POR) covering the period June 17, 2020, through September 25, 2021, and January 1, 2024, through December 31, 2024, for one producer of hardwood plywood subject to the antidumping duty (AD) and countervailing duty (CVD) reviews.

Commerce also determines that 16 exporters of hardwood plywood subject to the AD review, and 15 companies subject to the CVD review, had no shipments of subject merchandise during the period of review POR and have demonstrated that they should be eligible to certify that future shipments are not subject merchandise; four companies subject to the AD review are part of the China-wide entity because they did not demonstrate eligibility for separate rates; and the application of facts available with an adverse inference (AFA) is warranted for five companies subject to the AD review and eight companies subject to the CVD review, because the conditions of sections 776(a) and (b) of the Tariff Act of 1930, as amended, (the Act) are satisfied.

Finally, we are rescinding this review with respect to 73 companies. We invite interested parties to comment on these preliminary results.

On October 10, 2023, the U.S. Court of International Trade (CIT) issued its final judgment in Linyi Chengen Import and Export Co., Ltd., et al., v. United States, Consol. Court no. 18-00002, sustaining the U.S. Department of Commerce (Commerce)'s fifth remand results of redetermination pertaining to the less-than-fair-value (LTFV) antidumping duty investigation of certain hardwood plywood products (hardwood plywood) from the People's Republic of China (China). Commerce is notifying the public that the CIT's final judgment is not in harmony with Commerce's final LTFV determination. Consequently, the final antidumping duty margin calculated for mandatory respondent Linyi Chengen Import and Export Co., Ltd. (Chengen) is now zero percent and the rate assigned to the companies who received separate rates and are party to this litigation (Separate Rate Plaintiffs) is the rate assigned to Chengen, zero percent. In addition, because the final margin assigned to Chengen and the two companies that requested voluntary respondent treatment and submitted all of the threshold information necessary to be eligible for voluntary respondent treatment, Zhejiang Dehua TB Import & Export Co. (Dehua TB) and Xuzhou Jiangyang Wood Industries, Co., Ltd. (Jiangyang), is zero, Chengen, Dehua TB, and Jiangyang, in the exporter-producer combinations assigned in the investigation, are excluded from the Order.

On August 22, 2023, the U.S. Court of International Trade (CIT) issued its final judgment in Far East American, Inc., et al., v. United States, Consol. Court no. 22-00049 (Far Eastern), sustaining the U.S. Department of Commerce (Commerce)'s first remand results of redetermination pertaining to the final scope ruling for the antidumping and countervailing duty orders on certain hardwood plywood products (hardwood plywood) from the People's Republic of China (China). In the underlying ruling, Commerce determined that hardwood plywood exported into the United States by Vietnam Finewood Company Limited (Finewood) that was produced using two-ply panels imported into Vietnam from China was included in the scope of the orders. Commerce is notifying the public that the CIT's final judgment is not in harmony with Commerce's final scope ruling on Finewood's two-ply panels from China and is amending its final scope ruling.

This notice informs parties that Commerce has extended the deadline for certain exporters and importers to certify entries of hardwood plywood exported from the Socialist Republic of Vietnam (Vietnam) that were entered, or withdrawn from warehouse, for consumption on or after June 17, 2020, and until August 28, 2022. This notice also informs interested parties that Commerce is requesting comments regarding a potential modification to certification program eligibility, and the process for demonstrating eligibility for the certification program. In addition, this notice provides several other procedural notifications to interested parties.
